Air passenger rights and also the obligations of airlines are stipulated in EU regulation 261/2004. The European Parliament and the European Council have outlined cases in which airlines are obligated to pay compensation or give services to passengers.

EU air passenger rights apply:

  • when your flight was within the EU and was operated either by an EU or a non-EU airline
  • when your flight arrived in the EU from outside the EU and was operated by an EU airline
  • when your flight departs from the EUto a non-EU country and was operated by an EU or a non-EU airline

If passenger was not already received benefits from airline (compensation, re-routing, assistance from the airline) for flight related problems for this journey under the relevant law of a non-EU country.

For which flights does EU 261/2004 apply?

EU means all the 28 EU countries, including Guadeloupe, Martinique, French Guiana, Saint-Martin (French Antilles), Réunion Island, Mayotte, the Azores, Madeira and the Canary Islands as well as Norway, Iceland and Switzerland. It does not include the Isle of Man, the Faeroe Islands, and the Channel Islands.

The airline is obliged to provide the following services under EU Regulation 261/2004

Right to reimbursement or re-routing

Passengers shall be offered to have a choice between compensation of the total value of the ticket price t at the price at which it was bought or re-routing, under comparable transport conditions, to their final destination at the any earliest available flight.

Right to care

If the flight is delayed, the airline has to provide passenger with care services, such as meals and refreshments, as well as hotel accommodation in certain conditions and transport (transfer) between the airport and place of accommodation shall be offered free of charge. Once passengers are forced to wait an unreasonable amount of time in case of extraordinary circumstances, airlines has to provide passengers with appropriate care services.

  • Rights to have Food and drinks during waiting period.
  • Rights to make 2 Telephone calls & use Internet.
  • Rights to have Accommodation during waiting time in case of overnight stay and transfers to and from the airport.

Right to compensation

In the case of denied boarding, a delay of over 3 (three) hours or a cancelled flight, you’ll  be entitled to a compensation payment of up to 600 euros. The compensation amount depends on the duration of the delay and the flight distance.
